3DPixel Ltd. trading as 3DPixel.uk (The Provider) agrees to furnish services to the Client, subject to the following Terms Of Service.

Under Consumer Protection (Distance Selling) Regulations (2000) we will offer a full refund should you decide to cancel within 7 (seven) days of the start of our contract with you. We define the start of the contract as the day after you receive your welcome email from ourselves. There is no refund on domain names purchased as we ourselves have no recourse for refund from the global domain registry.
Refunds can be obtained by contacting us, payments will be refunded to your payment method within 7 working days.
All payments for hosting accounts to 3DPixel.uk are nonrefundable outside of the 28day period after which the Client has deemed to accept the service provided. All payment disputes or cases of overcharging must be reported to 3DPixel.uk within 28 days.
The Client acknowledges that the services provided is of such nature that services can be interrupted for many reasons other than the negligence of 3DPixel.uk and that damages resulting from any interruption of service are difficult to ascertain. Thus, the Client agrees that 3DPixel.uk shall not be liable for any damages arising from such causes beyond the direct and exclusive control of 3DPixel.uk. The Client further acknowledges that 3DPixel.uk's liability for its own negligence may not, in any event exceed an amount equivalent to charges payable by the Client for services during the period damages occurred. In no event shall 3DPixel.uk be liable for any special or consequential damages, loss or injury.
The Acceptable Use Policy specifically prohibits the use of 3DPixel.uk's service for illegal activities. Therefore, the Client agrees that the Provider may disclose any and all Client information including assigned IP numbers, account history, account use, etc... to any authorised authorities or agents who make a written request without further consent or notification to the Client. In addition 3DPixel.uk shall have the right to terminate all services set forth in this Agreement.
All domains are renewed on a two yearly basis, we will send out reminder emails 30 days, 10 days, 3 days before expiry. We will send the emails to the email address on the account, it is the registrants responsibility to make sure their contact details are up to date. 3DPixel.uk take no responsibility if your domain renewal fails due to your contact details being incorrect.
If you do not renew your domain before its expiry date it will have all services we provide suspended and you will have up to 30 days (protected period) after to renew the domain name at the original renewal fee. Please log into the client portal area to view renewal fees. After 30 days your domain will be suspended and will go into a 60 day grace period which you can still renew your domain name but with an additional redemption fee of £90 + VAT. This must be requested by email before the 80th day after your domain has expired, after 90 days your domain will be cancelled and deleted from the register and made available for resale through a third party registrar. 3DPixel.uk will not guarantee the renewal of a domain name.
New webhosting accounts which involve the transfer of a domain from another provider to 3DPixel.uk; whether they are FULL transfers or nameserver transfers, will require a period of time to propagate on to 3DPixel.uk's DNS servers. In some cases, such transfers may take up to sixty (60) days. Due to the unpredictable nature of the transfer process, no guarantees are made regarding the amount of time a specific transfer may take. It is the responsibility of the Subscriber to cover any administration and/or costs of the domain transfer to our DNS servers. The costs of service commence from the point of purchase and not from the point of apparent DNS completion. If the customer cancels service during the transfer period for any reason, all charges are considered earned. The 28 day refund period however, does commence from the moment the 3DPixel.uk DNS servers resolve the domain in question.
Transfer of a domain from 3DPixel.uk to another provider incur no additional fees.
3DPixel.uk provides technical support to the Client via email services. 3DPixel.uk staff limit technical support to their area of expertise. Email support is limited in the main to the hours of 8am to 8pm UK time. The servers are monitored and acted upon if necessary 24 hours a day 365 days a year.
The following is our guidelines when providing support:
3DPixel.uk takes a zero tolerance approach to the sending of Unsolicited Commercial Email or SPAM from the 3DPixel.uk servers. Very simply, this means that the Client of 3DPixel.uk may not use, or permit others to use 3DPixel.uk's network to transact in SPAM or Unsolicited Commercial Email. The Client may not host, or permit hosting of, sites or information that is advertised by Unsolicited Commercial Email from other networks. Violations of this policy carry severe penalties, including termination of service.
Upon investigation of alleged SPAM or Unsolicited Commercial Email activities, either via a third party, or via 3DPixel.uk's monitoring systems, 3DPixel.uk may restrict the Client access to 3DPixel.uk's network or servers for the duration of the investigation.
The Client acknowledges that accounts hosted by 3DPixel.uk shall not be used for "phishing" or other "scam" activities. Investigation protocols are as for SPAM violations.
Resale of 3DPixel.uk's services are permitted taking into account support boundaries described above. 3DPixel.uk allows use of these Terms & Conditions and indeed recommends the Client uses the same, or stricter wording when reselling 3DPixel.uk services.
The Client agrees that bandwidth and disk usage shall not exceed the number of megabytes per month for the services ordered by the Client. 3DPixel.uk will monitor the Client's bandwidth and disk usage. 3DPixel.uk has the right to take corrective action if the Client's bandwidth or disk usage exceeds the agreed usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all services, or termination of this Agreement, which actions may be taken is in 3DPixel.uk's sole discretion. If 3DPixel.uk takes any corrective action under this section, the Client shall not be entitled to a refund of any fees paid in advance prior to such action.
3DPixel.uk will charge £1 plus vat per total Gigabyte of traffic/bandwidth over and above the total monthly limit of the Client's account. This amount is due at the end of the calendar month.
The Client is forbidden to violate or attempt to violate the security of the 3DPixel.uk servers. Violations of system or network security may result in civil or criminal liability. 3DPixel.uk will investigate occurrences, which may involve such violations and may involve, and cooperate with, relevant authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
3DPixel.uk is not responsible for the content of any other websites linked to the 3DPixel.uk servers; links are provided as Internet navigation tools only.
3DPixel.uk is not responsible for any damages your business may suffer. 3DPixel.uk does not make implied or written warranties for any of our services. 3DPixel.uk denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by 3DPixel.uk.
It is absolutely forbidden to host pornographic content or IRC servers on 3DPixel.uk's servers. 3DPixel.uk accounts found hosting this material will be subject to immediate cancellation without refund.
You, as 3DPixel.uk's Client, are solely responsible for the content stored on and served by the Client's 3DPixel.uk account.
